    ORGANIZER

  • The Contest is organized by Groupe Première Moisson Inc. (individually and collectively the ‘Organizer’ or the ‘Contest Organizer’).
  • DURATION

  • The Contest runs over the following period of time (‘Contest Duration’)

    ELIGIBILITY

  • The Contest is open to residents of the province of Quebec who are of the age of majority at the time of entry.
    The following are excluded: directors, officers, executives, employees, agents and representatives of the Contest Organizer, its parent company, or any company, trust or other legal entity controlled by or affiliated with them, of Facebook if Contest is run on Facebook, of participating stores, advertising and promotional agencies, suppliers of prizes, goods and services related to this Contest, as well as the individuals with whom they reside (whether related or not).
  • PARTICIPATION / NO PURCHASE REQUIRED

  • No purchase is required to enter or win. A purchase does not increase the odds of winning.
    Participants must respect the following limits. If they fail to do so, they may be disqualified:
    1. There are ten (10) entry periods, one per day, on each one of Première Moisson’s Facebook and Instagram accounts. Each entry period starts at the time of posting on Facebook or Instagram and lasts until 9:00 a.m. on the day following the posting. At that time, a draw will be held among eligible entries.
    2. To enter the contest, participants must be subscribed to the Facebook page and/or Instagram account of Première Moisson and must comment on the contest post by answering the question in the post, within 24 hours of its posting.
    3. Limit of one Facebook entry and one Instagram entry per person per post. Entries generated by a script, macro, or other automated method are disqualified.

  • The odds of winning any given prize depend on the number of valid entries received during the Contest Duration period.
  • No warranty other than that of the manufacturer or supplier of the prize will apply. The Organizer is not responsible for the prize once awarded.
  • Prizes are subject to the terms and conditions of use of the supplier of the prizes. Prizes are not exchangeable, redeemable, or transferable, and are subject to the conditions of the supplier.
  • Draws:
    1. Draw dates: Every day from December 12 to 21, 2018
    2. Draw times: Daily at 9:00 a.m.
    3. The random draws will be held at the Organizer’s offices at 189 Harwood Blvd., Vaudreuil-Dorion QC JV7 1Y3.
  • CLAIMING OF PRIZES
      1. a) The winner of each prize will be announced in the comments of the daily Facebook and Instagram posts, one hour after the close of each contest entry period.
      2. b) All prize winners must claim their prize within 5 days following the close of the contest period for which their name was drawn.
      3. c) The winner of each prize must claim the prize at the Première Moisson branch of his or her choice.
    1. Selected entrants failing to comply with any of the conditions mentioned in these regulations or failing to accept the prize will be disqualified. In such an event, the Contest Organizer may, at its discretion, cancel the prize or re-draw from the remaining eligible entries until a participant is selected and declared a winner.
    2. For each draw: within 24 hours of the winner’s response, the Contest Organizer will contact the winner to let them know how to claim their prize.
      1. d) Refusal to accept a prize. The refusal of any selected entrant to accept their prize according to the terms of these regulations will release the Contest Organizer of any obligation toward that person regarding that prize.
      2. e) Awarding of prizes. No prize will be awarded unless the winner has been confirmed. Prizes are not transferable and must be accepted as is, without substitution in cash or otherwise, except at the sole discretion of the Organizer. The Organizer reserves the right to substitute a prize (or portion of a prize) for something of an equivalent type and value, or, at its sole discretion, for the monetary value of the prize (or portion of a prize) indicated in these regulations.
      3. f) Cost of claiming prizes. Any costs or expenses incurred by any winner to claim or use a prize are the responsibility of the winner.
      4. g) Limited prizes. In all cases, the Contest Organizer shall not be required to award more prizes or to award any given prize otherwise than as stated in these regulations.
  • GENERAL TERMS AND CONDITIONS
    1. Disqualification. All Contest-related documents, including but not limited to, entry forms, scratch cards, and Declaration and Release Forms, are subject to verification by the Contest Organizer. Contest Organizer reserves its rights, at its own discretion, to cancel any entry if such Entry was made by purchasing a product or products which was/were later returned by the participant. Such participant will have the opportunity to enter the Contest using the “No purchase required entry” if the delay set in these Rules is respected. Incomplete, illegible, mutilated, fraudulent or deteriorated entries as well as entries containing printing or other errors or that have been tampered with, spoiled, modified, falsified, reproduced or illegally obtained shall be rejected. Entrants who do not comply with these Rules are subject to be excluded from this Contest and any future contests and promotions the Organizer may hold, including, but not limited to, any entrant guilty or suspected: (i) of tampering with materials, entry forms, entry processing or the Contest’s conduct or any technical or mechanical element of the Contest, or (ii) of deliberately damaging Contest-related Web sites, Web pages or applications or of sabotaging the legitimate conduct of this Contest, or (iii) of breaking these Rules, or (iv) of using means that do not comply with the Rules or are unfair to other entrants, or (v) to have obtained entries exceeding the authorized limit provided in the Rules, or (vi) to have used several names, identities, e-mail addresses and/or any automated system or program to enter or participate in the Contest, or (vii) to have disrupted the conduct of the Contest in any other way, or (viii) of acting unfairly or to adversely affect, annoy, abuse, threaten or harass another person. ANY ATTEMPT BY AN ENTRANT OR OTHER PERSON TO DELIBERATELY DAMAGE A WEB SITE, EQUIPMENT, APPLICATION OR TECHNOLOGY USED FOR THE CONTEST OR INTERFERE WITH THE LEGITIMATE OPERATION OF THE CONTEST CONSTITUTES A VIOLATION OF CIVIL AND CRIMINAL LAWS. THE ORGANIZER RESERVES THE RIGHT, IN SUCH CASE, TO REPORT SAID PERSON TO THE AUTHORITIES AND DEMAND FROM SAID PERSON ALL DAMAGES ALLOWED BY LAW.
    2. Declaration and release form. In entering or attempting to enter this contest, any participant selected for a prize shall hold harmless the contest organizer, parent company or any other company, trust or other legal entity controlled by or related thereto, any participating store, the Régie des alcools, des courses et des jeux, Facebook if the contest is organized on Facebook, advertising and promotional agencies, suppliers of goods, services and prizes within the framework of the contest, as well as all respective directors, officers, owners partners, employees, authorized representatives successors and beneficiaries (jointly referred to as the ‘Releasees’) with respect to all damages and all liability relating to the contest (entry, operation, announcement, rules, etc.) or the contest prize (claim, use, etc.). To be declared winners, participants selected shall be obligated to sign a Declaration and Release Form containing a declaration in compliance with these contest rules and confirming the release of liability inuring to the benefit of the releasees.
    3. Limit of liability. Without restricting the generality of the foregoing release, the releasees shall be held harmless with respect to: (i) any typographical error (or other) contained in the offer or document relating to the administration of the contest, including, without limitation thereto, errors contained in advertising, the official rules, announcement of the winner, awarding of the prize or poor operation, issues or technical difficulties as relate to networks, telephone lines, SMS messaging systems, any computer component, any software or any communication line relating to the loss or absence of network communications or relating to any defective, incomplete or incomprehensible transmission or transmission deleted by any computer, server or service provider or any software, virus, computer bug, personal computer breakdown or software or material configuration, or failed attempt to transmit any e-mail or other message to the contest organizer or participant for whatever reason, including network overload or failure of any site as might limit the possibility of a person entering the contest; (ii) any late, lost, stolen, delayed, unreceived, damaged, improperly forwarded, incomplete or inexact contest entry; (iii) any failure to receive entries by reason of transmission problems or technical failures of any nature, including, but not limited to the deficient operation of any network, server, access provider, material or software, whether attributable to the sender or receiver as might limit or prevent a person from entering the contest; (iv) any damage as may be caused, directly or indirectly, in whole or in part, to the system or participant device or other person by reason of the downloading of a Web page or any software or other, or the transmission of any contest-related information.
    4. Operation of website. The contest organizer cannot in any manner guarantee that the contest website on Facebook will be accessible or operational without interruption for the duration of the contest or that the contest website will be devoid of errors.
    5. Cancellation, suspension or modification of contest. The organizer reserves the right, at the sole discretion thereof, to cancel, annul, terminate, modify or suspend, in whole or in part, this contest in the instance of an event as shall disrupt the proper operation of the contest, such as difficulty by the computer system to record contest entries or any human intervention as might alter or impact the administration, security, impartiality or operation of the contest as set out in these contest rules, subject to approval by the Régie des alcools des courses et des jeux du Québec, if required.
    6. Termination of contest. In the event that the contest were to be terminated in whole or in part prior to the end of the contest period, the draw may be staged, at the sole discretion of the contest organizer, from among eligible entries duly recorded during the contest period or, as the case may be, up to the date of the event having resulted in the termination of the contest.
    7. Personal information. In entering the contest, participants consent to the collection, use and disclosure of their personal information by the contest organizer and/or authorized agents with a view to administering the contest and awarding the contest prizes. In accepting a prize, winners hereby authorize the contest organizer and representatives to use, as required, their name, address (town/city, province), voice, declarations, photograph, image and other representations and recordings for advertising purposes in all media, including but not limited to the Internet, without prior notice and without compensation of any kind. All participants may be required to sign a confirmation in this regard.
    8. Intellectual property and copyright. In submitting a photograph, musical piece, creation or other manner of work (‘Work’) within the framework of the contest, the participant guarantees that such work is free of all third party rights and holds all necessary rights to submit such work and notably, but without limitation, to authorize the organizer to use, modify, transfer, adapt, broadcast, communicate or distribute, by whatever broadcast, media or technological means, including but not limited to television, information technology, wireless or online. The participant agrees, upon request, to provide proof of the rights pertaining to the work and to compensate the organizer in the event of any claim, demand, legal action or litigation arising from any manner of use of the work.
    9. Ownership. All information and documents relating to the contest, notably but without limitation, entry forms, scratch cards, declaration and release forms. Information of a technical, technological or operational nature, and information relating to drawings, computer systems, software, logos, trademarks and intellectual property are and shall remain the exclusive property of the contest organizer. None of this information and none of these documents shall be returned to participants.
    10. Identification of participant. For the purpose of these contest rules, the participant shall be deemed to be the person whose name appears on the entry form and to whom the prize shall be awarded if such person is selected and declared the winner. Should a dispute arise relating to the identity of the author of an entry form, the latter shall be deemed to have been sent by the authorized account holder of the e-mail address provided at the time of entry. ‘Authorized account holder’ shall refer to the physical person to whom an e-mail address is attributed by an Internet or online service provider, or other company as assigns e-mail addresses for the domain associated with the e-mail address submitted.
    11. Decisions by contest organizer. Any decision by the contest organizer or the representatives thereof in relation to this contest shall be final and without appeal, subject to any decision taken by the Régie des alcools, des courses et des jeux du Québec in relation to any matter falling within its jurisdiction.
    12. Disputes / Québec residents. Any litigation respecting the conduct or organization of a promotional contest shall be submitted to Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie for the sole purpose of helping the parties reach a settlement.
    13. Régie des alcools, des courses et des jeux. The Régie des alcools, des courses et des jeux du Québec shall in no manner whatsoever be bound by the contest and cannot be held liable in any manner whatsoever for any matter pertaining to the contest.
    14. Facebook. If the contest is hosted on Facebook, participants hereby agree to hold Facebook harmless respecting all liability and all damages of any nature whatsoever as may arise from entry in the contest and hereby acknowledge that the contest is in no manner sponsored, approved or administered by Facebook or otherwise associated therewith. The information provided by the participants is provided to the organizer and not Facebook.
    15. Contest rules in French and English. In the event of any discrepancy between the French and English language versions of the contest rules, the French language version of the rules shall take precedence.
    16. General. In entering the contest, participants agree to be bound by these contest rules and decisions by the organizer. The said decisions shall be final and without appeal, including but not limited to decisions respecting eligibility or disqualification of contest entry forms and awarding of prizes. This contest shall be subject to all applicable laws and regulations. Only participants selected shall be contacted. If any provision appearing herein shall be declared illegal or unenforceable by a court of competent jurisdiction, then such provision shall be deemed null and void, but all other provisions shall remain applicable.
