This premieremoisson.com website, including the Transactional Site, social media, mobile applications and other platforms belonging to Metro (collectively, the "Site"), is owned and operated by Metro Inc. its affiliates and subsidiaries, including Première Moisson Group Inc. ("Première Moisson") (collectively "Metro"), having its head office at 11011 Maurice-Duplessis Boulevard, in Montréal, province of Quebec, H1C 1V6. By accessing and using this Site, you unconditionally agree to be bound by the Terms of Use of the Site and by these terms of use relating the use of the Transactional Site, as they may be amended from time to time by Première Moisson (the "Terms") and all applicable laws. Use of our Site is limited to personal, non-commercial use.

By placing an order, you submit to the Terms. The Terms, together with any documents they expressly incorporate by reference, including, without limiting the generality of the foregoing, the Protection of Personal Information Policy, constitute the entire agreement relating to your use of the Transactional Site and the fulfillment of your order between you, on one hand and on the other hand, Première Moisson and the designated Première Moisson store ("Designated Store") that will be assigned to fulfill your order. You can place an order as a guest or by creating an account on our Site.

In the event of conflict between the terms and conditions of the above-noted documents, the Transactional Site Terms shall prevail with respect to any use of the Transactional Site. All other conditions, verbal or written, that the buyer might add to an order or other document that would alter these Terms are specifically excluded and considered null and void. Première Moisson reserves the right however to subject the sale of products and services to additional conditions which would be communicated at the time of purchase. The purchase receipt issued by the store where your order was prepared shall prevail over communications regarding your order.

Première Moisson reserves the right, at its sole discretion and for whatever reason, to refuse or cancel any on-line order or to ask you for additional information before accepting or refusing any on-line order or payment, in which case you would be notified by e-mail. Première Moisson shall be under no obligation to fulfill any such order and shall not be liable for any damages whatever resulting from its refusal or cancellation of an on-line order. You shall not have to pay for any such refused or cancelled order.

Your order: As Premiere Moisson cannot guarantee that all of the products that you order are available at the time of order, an order confirmation shall not be considered an acceptance of the offer. The sales contract shall be concluded when assembly of your order at the Designated Store is finished and payment by you has been completed. You consent to the assignment by Première Moisson of all its rights and obligations in your order to the Designated Store which shall see to the assembly of your order, receive payment from you and make the delivery, if applicable. Consequently, your invoice will be issued by the Designated Store, not by Première Moisson. The order will be delivery by vehicles and employees of the Designated Store whose name appears on your order confirmation.

Unauthorized commercial use: The Transactional Site is for personal, non-commercial use only. Première Moisson reserves the right, at all times and for whatever reason, to limit quantities of products purchased by a person, by account, by billing or delivery address or otherwise. You must be of full legal age in your province of residence to place an order on our Transactional Site. The person picking up or taking delivery of your order must have ID and, if the order includes one or more age-restricted products (proof of full legal age in his or her province of residence.

Order delivery or pick-up (including non-contact pickup): Order delivery is limited to the areas indicated on our Site, and the pick-up option is provided only by the participating stores indicated on our Site. When placing an order, you have to specify the method of receiving it, i.e. delivery or pick-up at one of our participating stores. You also have to select a time slot for delivery or pick-up.

Pick up: When you pick up your order in your time slot at the Designated Store, you may park your vehicle in the indicated pick-up spaces. If your vehicle is legally stationary, you may call the phone number indicated in the parking lot and the order will be brought out to your vehicle. You may also come to the pick-up counter to inform us of any desired changes. Please stick to your pick-up time slot.

Modifications to your order: You may always cancel an order by submitting your changes 48 hours prior to the scheduled pickup or delivery time. If you chose the pick-up method, you can also modify the products in your order at the store. Première Moisson reserves the right to charge cancellation fees for any order cancelled after the deadline indicated in the order confirmation or any order that was not picked up or that could not be delivered because no one was present to receive it during the delivery time slot. Modifications and substitutions by Première Moisson: Première Moisson reserves the right to offer you substitute products, if applicable. Première Moisson shall not be responsible for checking the presence of any allergens whatsoever in any products of your order or in any substitute products. Responsibility for the presence of allergens is solely yours, even should Première Moisson have prior notice of same.

Prices, discounts, promotions, coupons and taxes: All prices are in Canadian dollars. Prices, discounts, promotions and coupons may vary between the Transactional Site, our stores and the Designated Store responsible for the assembly of your order. The prices, discounts, promotions and coupons of the Designated Store, at the time of placing an order, will take precedence over any other prices indicated on our Site or order confirmation. When an order is placed in a period and the selected time slot for receiving it falls outside that period, the prices, discounts, promotions and coupons are subject to change and will be those of the period when the order was placed online.

Coupons and other discounts must be in effect at the time of payment of your order and may not exceed the total cost of your order.

Coupons are subject to the terms and conditions on the coupons, in addition to these Terms.

Only coupons downloaded and reproduced from this Site, coupons in digital form and authentic paper coupons shall be accepted in stores.

Only Première Moisson digital coupons appearing on the Site with a promotional code may be used for an online order and you must enter the applicable promotional code when placing an online order. Digital and paper coupons cannot be used with online orders if they do not contain promotional code.

Incomplete, illegible, electronically or physically altered, fraudulent or otherwise corrupted coupons as well as coupons not downloaded or reproduced from our Site or that have been modified or falsified shall be rejected.

Applicable taxes are calculated based on the actual price of your order at the time of final payment.

Payment: When you order on the Transactional Site, you need to provide your credit card payment information for your order to be submitted. When your order is completed online on our Transactional Site, the Designated Store will charge the actual price of your order to your credit card. If your payment is refused by Première Moisson, the acquirer, issuer or financial institution and in the absence of an alternative arrangement, your order will not be completed and Première Moisson shall have no further obligation in this regard. In giving us your credit card payment information, you represent and warrant that you are the cardholder of that credit card.

Delivery fees: Every order on our Transactional Site is subject to delivery fees. These fees may vary depending on your Designated Store at the time of your order and the invoice total before taxes. Première Moisson reserves the right to change these fees and the minimum purchase required.

Limitation of Liability

Première Moisson shall not be liable for any loss, damages or claims of any kind, either direct or indirect, incidental, exemplary, special or consequential, including the loss, alteration, or communication of any data, any delay, force majeure, product/service price or attribute errors, product errors, substitutions, missing products, inaccurate product/service descriptions (collectively "damages"), whether or not it has been informed of the possibility of such issues resulting from the use of this Site and/or any unassembled or undelivered order (other than refunding the order if it was paid for).Your sole and exclusive remedy is to discontinue using this Site and/or to ask, in person at the Designated Store, for a refund or exchange of the products in question depending on the Designated Store’s refund and exchange policy. No information on this Site may be construed as creating any warranty not expressly stipulated in these Terms.

Use of information and errors

The information displayed on the Site is provided for informational purposes only, unless otherwise stated. Première Moisson makes no warranties, either express or implied, that the quality of the offers will meet your expectations and that the information, which includes advertising as well as nutritional and health tips, is appropriate to your needs and health condition.

Première Moisson is proud of the Site and works hard to keep it updated and error-free. However, price errors or product/service description errors or inaccuracies, including colour, origin, category or others characteristic may occur. Première Moisson reserves the right 1) to correct any such errors, at its sole discretion, at any time and without prior notice and 2) to refuse, cancel or correct any order containing such price or description errors or inaccuracies.
